Welcome to thepremiumroses.com. Premium Roses is a brand operated by YMK Enterprises LLC. These terms are the agreement between you and YMK Enterprises LLC ("Premium Roses," "we," "us," or "our") when you use our website or buy from us. By browsing the site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

1. Who we are and what we sell
Premium Roses sells preserved rose gift boxes and arrangements, and provides preserved rose centerpieces for weddings and events. Our roses are real roses that have been preserved; they are decorative keepsakes, not fresh cut flowers and not food.
2. Orders
Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation. We may decline or cancel an order — for example if an item is out of stock, if there's a pricing or description error, if we can't deliver to the address given, or if we suspect fraud. If we cancel an order you've already paid for, we'll refund you in full.
We try to keep product descriptions, photos, and prices accurate, but we don't warrant that everything on the site is error-free. Because these are natural roses, slight variation in tone, size, and shape between individual arrangements is normal and is not a defect.
3. Prices and payment
Prices are in US dollars and don't include applicable taxes or shipping unless stated. We may change prices at any time, but a change won't affect an order we've already confirmed. Payment is taken through our payment providers at checkout. You confirm you're authorized to use the payment method you provide.
4. Shipping and delivery
We ship within the United States. Same-day delivery is available in our Chicago-area service area for orders placed before the cut-off time posted on our Shipping & Delivery page.
Delivery dates are estimates. Once a package is with the carrier, delays caused by the carrier, by weather, or by an incorrect or incomplete address are outside our control. Please double-check the recipient's address before submitting your order — we can't guarantee a change after an order enters fulfillment.

5. Returns and exchanges
Our returns and exchanges policy is on our Returns & Exchanges page, which forms part of these terms. If something arrives damaged, contact us within the window stated there with photos and we'll make it right.
6. Care and use of the product
Preserved roses are decorative. Keep them out of direct sunlight, away from heat and humidity, and do not water them. They are not edible, not a toy, and should be kept away from small children and pets. Handle gently — petals can be fragile.
7. Events and rentals
Centerpieces and arrangements provided for weddings and events may be governed by a separate written agreement or quote covering deposits, timing, damage, and return of rented items. Where a separate agreement exists and conflicts with these terms, that agreement controls for that booking.
8. Your use of the site
Don't use the site to do anything unlawful, don't attempt to gain unauthorized access to it, don't scrape or copy it systematically, don't interfere with its operation, and don't submit anything false or infringing. We may suspend access if you do.
9. Content you submit
If you post a review, photo, or other content, you keep ownership of it, and you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business, including in marketing. You confirm the content is yours to share and doesn't infringe anyone else's rights. We may remove content at our discretion.
10. Our content
Everything on this site — text, photographs, graphics, logos, and the Premium Roses name — is owned by us or our licensors and protected by intellectual property law. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.
11. Third-party links and marketplaces
Our site may link to other sites, and we sell through marketplaces such as Amazon and Etsy. We don't control those sites and aren't responsible for their content, terms, or privacy practices. Purchases made on a marketplace are governed by that marketplace's terms as well as ours.
12. Disclaimers
The site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted or error-free.
Nothing in these terms limits any warranty or right you have that cannot be limited under applicable law.
13. Limitation of liability
To the fullest extent permitted by law, Premium Roses will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
Some states don't allow certain limitations, so parts of this section may not apply to you.
14. Indemnity
You agree to indemnify and hold Premium Roses harmless from claims and costs arising out of your misuse of the site, your violation of these terms, or your violation of anyone else's rights.

16. Governing law
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Illinois, and you and we consent to their jurisdiction. This does not affect any right you have to bring a claim in your local small-claims court or to the protections of the consumer laws of the state where you live.
17. Changes to these terms
We may update these terms. The version in effect when you place an order is the version that applies to that order. We'll update the effective date at the top when we make a change.
18. General
If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. These terms, together with the pages referenced in them, are the entire agreement between you and us about the site and your order.
